L’offerta e la vendita di prodotti sul sito web agplex.it sono regolate dalle seguenti Condizioni Generali di Vendita.
I prodotti acquistati su agplex.it sono venduti direttamente da agplex, con sede legale in Italia.
Potrai richiedere qualsiasi informazione  tramite email info@agplex.it, ivi comprese informazioni in merito ad ordini e spedizioni, ai rimborsi ed alla restituzione dei prodotti acquistati su agplex.it

1. Our commercial policy

1.1 The Seller offers products for sale on agplex.it and conducts its e-commerce business exclusively with its end users who are “consumers.”
1.2 When we refer to a “consumer,” we mean any natural person who uses agplex.it for purposes unrelated to their commercial, business, or professional activities, if any. If you do not qualify as a “consumer,” we ask that you refrain from entering into commercial transactions through the agplex.it website.
1.3 In accordance with its commercial policy, the Seller reserves the right not to process orders from parties other than “consumers” or, in any case, orders that do not comply with its commercial policy.
1.4 These General Terms and Conditions of Sale exclusively govern the offer, submission, and acceptance of purchase orders for products on agplex.it, with the express exception of the provisions set forth in Section 1.5.
1.5 The General Terms and Conditions of Sale do not apply to the provision of services or the sale of products by parties other than the Seller that may be present on agplex.it via links, banners, or other hyperlinks. We recommend that, before placing orders and purchasing products and services from parties other than the Seller, you review their terms of sale, as the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of e-commerce transactions between users of agplex.it and third parties.

2. How to conclude the contract with agplex.co.uk

2.1 To enter into a purchase agreement for one or more products on agplex.it, you must complete the electronic order form and submit it to the Seller electronically, following the relevant instructions.
2.2 The order form includes a reference to these General Terms and Conditions of Sale, as well as a summary of the essential characteristics of each product ordered and its price (including all applicable taxes or duties), the payment methods available for purchasing each product, the delivery terms for the purchased products, and the shipping and delivery costs, a reference to the conditions for exercising your right of withdrawal, and the procedures and timeframes for returning the purchased products.
2.3 The contract is concluded when the Seller receives your order form electronically, after verifying the accuracy of the information related to your order.
2.4 Before proceeding with the purchase of products by submitting the order form, you may carefully read the General Terms and Conditions of Sale and the Notice on the Right of Withdrawal, print a copy using the print command, and save or reproduce a copy for your personal use.
2.5 The order form will be stored in our database for the period of time necessary to process the orders and, in any case, in accordance with the law.
2.6 Before submitting the order form, you will also be asked to identify and correct any errors in the data you entered.
2.7 The language available for entering into the contract with the Seller is Italian.
2.8 Once the contract is concluded, agplex.it will process your purchase order.
2.9 The Seller may decline to process your purchase orders if they do not provide sufficient guarantees of solvency, are incomplete or incorrect, or if the products are unavailable.
In such cases, we will notify you by email that the contract has not been concluded and that the Seller has not processed your purchase order, specifying the reasons.
If the products featured on agplex.it are no longer available or for sale at the time of your last visit to the site or when you submit the order form, the Seller will notify you promptly—and in any case within thirty (30) days from the day following the date on which you submitted your order to the Seller—of any unavailability of the ordered products.
If you have submitted the order form and paid the price, the Seller will refund the amount you have already paid.
2.10 By electronically submitting the order form, you unconditionally accept and agree to comply with these General Terms and Conditions of Sale in your dealings with the Seller. If you do not agree with any of the terms set forth in the General Terms and Conditions of Sale, we ask that you refrain from submitting the order form to purchase products on agplex.it

2.11 By submitting the order form, you confirm that you have read and accept the General Terms and Conditions of Sale and the additional information contained on agplex.it—including information accessed via links—such as the General Terms of Use, the Right of Withdrawal Notice, and the Privacy Policy.
2.12 Once the contract is concluded, the Seller will send you, via email, a purchase order receipt containing a summary of the information already included in the order form (information regarding the product’s essential characteristics and a detailed breakdown of the price, payment methods, and delivery costs).
2.13 Please note that the product you are purchasing is intended exclusively for the country in which you place the order; therefore, if you decide to bring the product into a different country, you will be responsible for doing so and will be required to comply with the applicable regulations and restrictions governing both the export from the country where you purchased the item and the import into the country where you intend to take it. Agplex.it hereby disclaims all liability in this regard.

3. Guarantees and indication of product prices

3.1 Le caratteristiche essenziali dei prodotti sono presentate su agplex.it all’interno di ciascuna scheda prodotto. Le immagini ed i colori dei prodotti offerti in vendita su agplex.it potrebbero tuttavia non essere corrispondenti a quelli reali per effetto del browser Internet e del monitor utilizzato.
3.2 I prezzi dei prodotti potrebbero essere soggetti ad aggiornamenti. Accertarti del prezzo finale di vendita prima di inoltrare il relativo modulo d’ordine.
3.3 In caso di recesso, il consumatore è responsabile dell’eventuale diminuzione di valore derivante da una manipolazione del prodotto diversa da quella necessaria per verificarne natura, caratteristiche e funzionamento.

4. Payments

4.1 I metodi di pagamento disponibili sono indicati nel checkout prima della conferma dell’ordine.
4.2 Le transazioni vengono gestite tramite operatori di pagamento autorizzati e secondo le rispettive condizioni e informative. Agplex riceve esclusivamente le informazioni necessarie alla gestione dell’ordine e della transazione.
4.3 Gli eventuali rimborsi vengono effettuati tramite lo stesso metodo utilizzato per l’acquisto, salvo diverso accordo espresso, senza costi aggiuntivi per il cliente.

5. Right of withdrawal

5.1 Il consumatore può recedere dall’acquisto di prodotti standard entro 14 giorni di calendario dal ricevimento, senza penalità e senza dover indicare una motivazione.
5.2 Il diritto di recesso non si applica ai beni confezionati su misura o chiaramente personalizzati, fatti salvi i diritti relativi a prodotti difettosi o non conformi.
5.3 Salvo diverso accordo, i costi diretti della restituzione dovuta a ripensamento sono a carico del consumatore. Il rimborso comprende la consegna standard iniziale ed è disposto entro 14 giorni dalla comunicazione del recesso; può essere sospeso fino al ricevimento dei beni o della prova della loro spedizione.

6. Shipping Damage and Product Inspection

6.1 Al momento della consegna il cliente è invitato a verificare l’integrità dell’imballo e, in presenza di danni visibili, a formulare una riserva specifica al corriere.
6.2 In caso di prodotto danneggiato, errato o non conforme, il cliente è invitato a scrivere tempestivamente a info@agplex.it, preferibilmente entro 48 ore per facilitare la verifica con il vettore, allegando il numero d’ordine e fotografie del prodotto e dell’imballaggio.
6.3 La mancata segnalazione entro 48 ore non limita i diritti riconosciuti al consumatore dalla garanzia legale. Restano esclusi dalla garanzia i danni causati da uso improprio, montaggio non corretto, urti o cause esterne successive alla consegna.

8. Governing Law and Dispute Resolution

8.1 The General Terms and Conditions of Sale are governed by Italian law and, in particular, by Legislative Decree No. 206 of September 6, 2005, on the Consumer Code, with specific reference to the provisions regarding distance contracts, and by Legislative Decree No. 70 of April 9, 2003, on certain aspects of electronic commerce.

9. Modification and Update

9.1 Le Condizioni Generali di Vendita possono essere aggiornate anche in considerazione di eventuali mutamenti normativi. Le nuove condizioni sono efficaci dalla data di pubblicazione su agplex.it.
